GENERAL TERMS AND CONDITIONS
These general terms and conditions of sale apply to any order transmitted on the websites www.formeitalia.net of Forme Italia s.r.l. Confirmation of the order by the purchaser implies unreserved acceptance of these general terms and conditions of sale which prevail over all previous versions or specific versions generated by the purchaser, including the exchange of e-mails.
ORDERS
Offer of products
In the event that the requested payment card transaction has been authorised by the secure service, the order is processed on the working day following the day on which the payment was successful. Product offers, presented on this Site in the E-Commerce section, are valid within the limits of available stocks and subject to availability from suppliers. Products are presented as accurately as possible. For each product, the price, availability, and weight of each purchasable unit are indicated in the E-Commerce section. In the case of tiles, mosaics and parquet, both weight and price refer to 1 SQM of product.
Tile and parquet samples
To help you choose the product you want, through the online purchase procedure you can request tile and parquet samples that you can find in the E-Commerce section of this site. These samples can be shipped together with the other products ordered in the same E-Commerce section of the site. The cost of such shipment is calculated on the basis of the weight of the sample and, if it is requested together with other products, is included in the total shipping costs.
Order acceptance
The order remains firm for the purchaser from the moment of "Order Confirmation".
Order cancellation
If after 7 days from the moment the order is placed Forme Italia s.r.l. does not receive the payment, the order shall be considered cancelled.
PRICE AND PAYMENT
Price of the Products
The prices of the Products are indicated in Euros, VAT included. The prices displayed on this website are valid exclusively for online purchases.
Delivery costs
The cost of transport will be calculated automatically according to the weight of the items in the order and the destination location. In any case, the amount of shipping costs is shown in the final summary, BEFORE the actual conclusion of the purchase procedure.

DELIVERY AND RETURN
Methods of delivery
Without prejudice to the general maximum limit imposed by Article 6 of Legislative Decree no. No. 185/1999, the goods ordered shall be delivered to the consumer preferably within 4 working days from the day after receipt of confirmation of payment of the goods, without any delays constituting grounds for withdrawal from the contract or giving rise to rights to compensation, except as provided for by the aforementioned art. 6 of Legislative Decree No. 185/1999. N° 185/1999. With the publication of the wording Forme Italia s.r.l. guarantees the availability of those products listed in its online e-catalogue at the time of publication of the same are in its warehouses. If the availability of all the products ordered is immediate, as soon as Forme Italia s.r.l. receives from the customer the amount of the order including shipping costs, the goods will be taken over by the express courier and will be delivered to the address indicated in the order. In the event that one or more products of the order are not immediately available, the order, even if paid, will be processed when all the goods are available. In any case, the staff of Forme Italia s.r.l. shall inform the customer of any delays in delivery times. In any case, Forme Italia s.r.l. cannot guarantee that any reorders of sold-out lots can be processed, in which case it shall inform the customer and refund the amount already paid, in the form and manner provided for by art. 6 n.2 of Legislative Decree no. 185/1999. Receipt and complaints
The purchaser must proceed, at the time of delivery, with all necessary inspections to detect any faults, missing packages, defects or other apparent defects or non-conformities of the products delivered with his order. In this case, the purchaser must check that the number of packages corresponds to the number indicated on the delivery note and the condition of the packaging, which must be undamaged. Upon delivery, the purchaser shall sign ''subject to inspection''. If there is damage that is clearly visible from the outer packaging, the purchaser must add details of the damage to the reserve for inspection.
Liability
Forme Italia s.r.l. does not assume any liability for inefficiencies attributable to force majeure such as accidents, explosions, fires, riots, strikes and/or lockouts, earthquakes, floods, damage to computer systems, system crashes, and other similar events that prevent, in whole or in part, the execution of the contract within the agreed timeframe. Forme Italia s.r.l. shall not be liable for any damages, losses and/or costs suffered as a result of the non-execution of the contract due to the aforementioned causes, the consumer being entitled only to the refund of the price paid. Likewise Forme Italia s.r.l. shall not be liable for any fraudulent and illegal use of credit cards, cheques and other means of payment.

Warranty
Forme Italia s.r.l. markets products of a high quality level, for which any warranty provided for by law is directly provided by the manufacturers and the reference regulations as well as the methods of application of the warranty shall be those indicated and highlighted by the manufacturer together with the product.
RIGHT OF WITHDRAWAL
Consumer's right of withdrawal
Sales of products via the Internet are governed by Legislative Decree no. 206/05 (Articles 50 to 68), which regulates the subject of distance contracts, i.e. those made outside business premises. This legislation sanctions the right of withdrawal, i.e. the possibility for the consumer to return the purchased product and obtain reimbursement of the expense incurred excluding return shipping costs. This right is reserved exclusively for natural persons (consumers), so it cannot be exercised by legal persons and natural persons acting for purposes relating to their professional activity, if any. In order to exercise the right of withdrawal, it is necessary to send, within 14 working days of receipt of the goods, a communication stating the wish to withdraw from the contract. The cost of returning the product shall be borne by the consumer.
Procedure for exercising the right of withdrawal

Arrange, using a courier of your choice, for the shipment of the product carefully packed in its original packaging and complete with all accessories, instruction manuals and everything originally contained therein.
Insure the shipment against theft and transport damage and bear the relevant costs. If the returned product has not been insured for the value indicated in the invoice, in the event of damage or loss during transport, Forme Italia s.r.l. reserves the right to charge for any damage incurred by deducting it from the amount to be refunded.

Forme Italia s.r.l. will proceed, by bank transfer, to reimburse only the cost of the goods shipped within 14 working days following the return of the goods and in any case not before receiving the goods. Please indicate your bank details and include this information with the returned goods.
Conditions of return
Return shipping costs are always charged to the customer who may return any item (with the exception of customised or easily perishable products) in a substantially undamaged and correctly stamped condition.
Forme Italia s.r.l. shall bear all expenses in case of defective or broken items delivered.
In the event that the order is not delivered within the foreseen terms for reasons not attributable to us (e.g. incorrect address provided), the customer shall bear the costs of redelivery and storage costs, which shall be calculated from time to time.
The purchase contract is automatically cancelled when the return arrives at its destination and the customer will be refunded within 14 days. If the customer has paid by bank transfer, his bank details will be requested in order to process the refund.
